Summary:
Our client was a tenant at a property with a lease agreement that allowed him to purchase the property after paying rent for several years. Despite our client paying rent each month, the original landlord stopped paying the mortgage and the property was foreclosed upon without our client’s knowledge. After the foreclosure, the new buyer entered the property during the night and moved all of our client’s personal property to the street and changed the locks, so to begin remodeling the property to sell.
We immediately filed a lawsuit against the buyer, alleging several causes of action related to wrongful eviction. After we prevailed on the preliminary injunction allowing our client to return to the property (delaying the buyer’s plan for remodeling), the buyer quickly agreed to settle for $95,000.00.
